From the family… 

The water situation is somewhat ambiguous due to the Town of Ridgway having priority. The language in the decree states we own all the water that flows in the ditch which the Town does not use for "domestic and municipal" purposes. Since the Town does not measure the amount of water they use, we have never been able to quantify the exact amount of water we get. All I can tell  you is that we have been supplied water most every year, but at the Town's discretion. We can clarify these rights if a Buyer is interested after viewing. In the event a Buyer does purchase this property, there will need to be some sort of water agreement which will be made between them and myself, since my property (which sits down stream) has irrigated land. 

Other info…the home (which sits on Lot 10) has a Well that produces 17 gpm and most other properties around me have ample ground water. Utilities boarder the property in CR5 and will need to be brought in. There is no maintained road accessing any of the parcels. There is an Elk Foundation easement which borders this property on the North and East boundaries. There are no covenants or restrictions, but any structure will be bound to the Ouray County Planning and Zoning. This is considered Alpine Zone, and the density is restricted to a 35 acre minimum.
